Please read these Terms of Service ("Terms") carefully before using MotorMigo (the "Service") operated by Balsam Data Strategies LLC ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Disclaimer: Not Professional Advice

MotorMigo is a tool for guidance only. The App provides inspection checklists and AI-generated reports based on data you provide or data found online. We are NOT licensed mechanics, and our Service is not a substitute for a professional mechanical inspection.

  • The Service does not guarantee the actual condition of any vehicle.
  • Any decisions made based on MotorMigo reports are at your own risk.
  • We always recommend having a vehicle inspected by a qualified professional mechanic before purchase.

2. AI-Generated Content Disclaimer

The Service utilizes artificial intelligence (AI) and Large Language Models (LLMs), currently Google Gemini, to generate vehicle reports and insights. We may change models or providers over time.

  • Accuracy: AI models can make mistakes ("hallucinations"). While we strive for accuracy, the generated reports may contain errors, omissions, or misinterpretations of the provided data.
  • No Guarantee: The AI's analysis is a probabilistic prediction based on patterns and does not constitute a guarantee of vehicle condition or value.
  • User Responsibility: You are responsible for verifying any critical information with official sources (e.g., manufacturer specifications, official vehicle history reports, professional mechanic inspections).

3. Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

4. Subscriptions & Purchases

Some parts of the Service are billed on a subscription basis ("Subscription(s)") or as one-time purchases.

4.1 Apple App Store & Google Play Store

  • Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
  • Auto-Renewal: Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Management: You can manage and cancel your subscriptions by going to your account settings using the "Manage Subscription" link in the App or directly in your App Store / Play Store account settings.
  • Refunds: All purchases are final and managed directly by the Apple App Store or Google Play Store according to their respective refund policies.
  • RevenueCat: We use RevenueCat as a service provider to validate purchases and manage subscription status.

5. User Content & License

You retain ownership of the content you submit to MotorMigo (such as inspection notes and photos). You grant us a limited, non-exclusive, worldwide license to host, process, and display your content solely to provide and improve the Service.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Balsam Data Strategies LLC and its licensors.

7. Links to Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Balsam Data Strategies LLC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party web sites or services.

8. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Limitation of Liability

In no event shall Balsam Data Strategies LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Service Availability & Jurisdiction

MotorMigo is offered in multiple countries and may not be available everywhere. You are responsible for complying with local laws where you access or use the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
